These Terms of Service (“Terms”) govern your access to and use of Themeatos (the “Site”), including purchases of digital products, memberships, and related services operated by Themeatos (“we”, “us”, or “our”). By creating an account, placing an order, or using the Site, you agree to these Terms.
1. Acceptance of Terms
By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced herein (including our License and Privacy Policy pages). If you do not agree, do not use the Site or purchase products.
2. Eligibility & Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make a purchase. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate billing and contact information and keep it up to date.
We may refuse registration, suspend access, or terminate accounts that appear fraudulent, abusive, or in violation of these Terms.
3. Products & Licensing
The Site sells digital goods such as WordPress plugins, themes, templates, and related assets. Purchases grant a license to use the product according to the applicable license terms — not ownership of the underlying intellectual property.
Unless a product page states otherwise, single-product purchases include a commercial license suitable for use on your own projects and client projects, subject to the restrictions on our License page. Resale, redistribution, or offering our products as a competing marketplace or “nulled” download is prohibited.
4. All-Access Membership
All-Access memberships provide time-limited (or lifetime, where purchased) download rights to eligible products in our library during the active membership period. Membership does not transfer ownership of products. Download limits, plan features, and renewal terms are described on the membership page at the time of purchase.
When a subscription ends and is not renewed, you retain licenses for items you already downloaded under the plan terms then in effect, but you lose access to new downloads and future updates unless you repurchase or renew.
5. Orders, Pricing & Payment
Prices are shown on the Site and may change at any time. Taxes, if applicable, may be calculated at checkout. Payment is processed by our payment provider (for example, Paddle or other processors we designate). Your relationship with the payment provider may be subject to their own terms.
An order is confirmed when payment succeeds and we send an order confirmation (email and/or account access). We reserve the right to cancel or refuse orders that appear fraudulent or that we cannot fulfill.
6. Refunds
Digital products are non-refundable. Individual product purchases are final and non-refundable.
Because products are delivered digitally and immediately after payment, all sales are final. Chargebacks initiated without contacting us first may result in account suspension.
7. Downloads & Updates
After a successful purchase or under an active membership, you may download products from your account. You are responsible for backing up downloaded files. We provide updates according to the product or membership terms; we do not guarantee perpetual updates for every product indefinitely unless a Lifetime plan or product page expressly says so.
Support is provided as described on each product or membership plan. Support does not include custom development, third-party plugin conflicts outside our control, or server configuration beyond reasonable guidance.
8. Prohibited Use
You agree not to:
- Share, resell, rent, or redistribute our products or license keys outside the allowed license;
- Remove copyright notices, license checks, or branding from products except where the license expressly allows white-labeling;
- Attempt to reverse engineer, scrape, or overload the Site;
- Use the Site for unlawful, harmful, or deceptive purposes;
- Circumvent download limits, membership rules, or security measures.
9. Intellectual Property
All Site content, branding, and products are owned by Themeatos or its licensors and are protected by intellectual property laws. “Themeatos”, “Themeatos”, and related marks are our trademarks. You may not use our marks without prior written permission, except to truthfully identify products you purchased from us.
10. Disclaimer & Limitation of Liability
The Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
To the maximum extent permitted by law, Themeatos and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business, arising from your use of the Site or products. Our total liability for any claim relating to a purchase will not exceed the amount you paid for that purchase in the twelve (12) months before the claim.
11. Termination
We may suspend or terminate your access if you breach these Terms, abuse the Site, or engage in fraudulent activity. Upon termination for cause, licenses granted under a breach may be revoked. Sections that by nature should survive (including licensing restrictions, IP, disclaimer, and limitation of liability) will survive termination.
12. Changes to Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. For material changes, we may provide additional notice via email or a Site notice.
